Charges: ORS 163.165 – Assault in the Third Degree
Narrative:On 01/19/23, at approximately 7:45 pm deputies with the Deschutes County Sheriff’s Office responded to Pine Nursery Park after receiving a report of a possible robbery. Initial reports detailed the victim had been assaulted and the assailants had attempted to take his money.The victim advised Deschutes County 911 three to four assailants left in two separate vehicles travelling east on Yeoman Road. Deputies responded to the area and contacted the victim while other responding deputies attempted to locate the suspect’s vehicles.As a result of the investigation, it was determined the victim was dropping a family member off at the Pine Nursery Park, and witnessed multiple vehicles driving in a dangerous manner, spinning their tires causing the vehicles to move in a circular motion, commonly referred to as “cookies” or “donuts”.
The victim was approached by a male subject who was threatening violence and provoking the victim to physically fight. When the victim refused to engage with the male subjects, he began assaulting him. The victim was restrained by a second assailant and not able to defend himself. The victim attempted to defend himself with a leatherman style tool and was eventually able to break free of one of the suspects. The victim received non-life-threatening injuries as a result of the assault by the males. Deputies responding to the area eventually located one of the suspect vehicles and initiated a high-risk traffic stop at the corner of Hamby Road and Neff Road. One of the suspects in the assault was taken into custody without incident, and transported to the Deschutes County Resource Center where he was lodged on the above-mentioned charge. The second suspect, a 15-year-old juvenile male, was not located, and is being sought by the Deschutes County Sheriff’s Office for questioning.
